Data protection information for myTalentscout GmbH’s social media- presence

In the following, we will inform you which personal data is processed when you visit our social media presence. In Part A of our data protection information, you will find general information on the processing of your personal data. In Part B, we inform you about the online presences we maintain.  

A. General information 

1. Controller  

Insofar as the personal data transmitted by you is processed exclusively by us as the operator of a social media presence, the data processing controller within the meaning of the General Data Protection Regulation (GDPR) and other data protection regulations is:

In cases in which the data transmitted by you is also or exclusively processed by the respective provider of a social media presence, the provider is also the controller in the sense of the General Data Protection Regulation (GDPR) and other data protection regulations. 

2. Definitions 

 The GDPR applies to the processing of personal data in our company.   

“Personal data” means any information relating to an identified (specific) or identifiable (determinable) natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.  

“Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.  

Through the processing your personal data, you become the data subject. For this reason, the rights to which you are entitled are also referred to as "data subject rights".   

3. Scope of the processing of data  

When using our social media presence, the following data may be processed from you: 

·       Access data such as date and time of access, IP address, browser and device information

·       Usage data, such as websites visited, interest in content, access times 

·       Contact and content data, such as e-mail, telephone number, requests, attachments (photographs, video recordings) 

·       Inventory data, such as names, addresses

4. Purpose and legal basis  

We maintain our social media presence in order to be able to communicate better with customers and interested parties and to provide information about our range of services or about myTalentscout GmbH.    

The processing is usually carried out by the social media providers for market research and advertising purposes. Profiles can be created from the usage data obtained in order, for example, to display advertisements that presumably correspond to the interests of the users. The legal basis for this is Article 6 para.1 point f of the GDPR.

6. Your rights  

Due to the fact that only the providers of the social media presences have access to user data, we recommend exercising the rights mentioned below directly against the providers. Therefore, we would like to refer you to the following links of the respective providers:

In respect of personal data relating to you, as a data subject you have the right against us: 

·       to obtain confirmation from us as to whether personal data relating to you is being processed (Article 15 of the GDPR), 

·       to receive information about the personal data stored about you free of charge at any time and to receive a copy of this information (Article 15 of the GDPR), 

·       to request the immediate correction of your incorrect personal data or its amendment (Article 16 of the GDPR), 

·       to request that your personal data be erased without delay, e.g. if you withdraw your consent (Article 17 of the GDPR), 

·       to demand the restriction of processing under certain conditions (Article 18 of the GDPR), 

·       to data portability, which grants, among other things, a right to receive the relevant personal data provided by you in a structured, commonly used and machine-readable format (Article 20 of the GDPR), 

Insofar as personal data is processed on the basis of our legitimate interest, you also have the right to object to the processing of your personal data with effect for the future in accordance with Article 21 of the GDPR, insofar as there are reasons for this arising from your particular situation.  

You have the right to complain to a data protection supervisory authority about the processing of your personal data by us (Article 77 of the GDPR). 

7. Transfer to third countries  

Personal data will only be transferred to third countries with a recognised level of data protection, with a contractual obligation through so-called standard protection clauses of the EU Commission, in the event of the existence of certifications or binding internal data protection regulations (Article 44 to 47 of the GDPR). 

When using our social media presences, your data may also be processed outside the area of the European Union. This may result in risks for the users because, for example, the enforcement of the rights of the users could be made more difficult. In cases where data processing also takes place outside the EEA (e.g. in the United States), there is – without an adequacy decision by the EU Commission – not the high level of data protection as is customary in the European area. Possible risks associated with a data transfer cannot be excluded. In particular, your data may be used by the authorities for control and monitoring purposes beyond the actual purpose and there may be no effective remedy against these authorities that enables you to establish and sustainably enforce your data protection rights. 

8. Changes to the data protection information 

This data protection information is current as of 01/02/2022. 

The change of legal requirements as well as the adaptation of the range of services on the fan page or the other social media presences may necessitate a change to this data protection information. are the controllers responsible for data processing within the meaning of the General Data Protection Regulation (GDPR) and other provisions of data protection law.  

B) Data processing  

When you visit our other social media presences, cookies are usually also placed on your device. As far as we are aware, the respective providers process the data for the purposes of advertising, the creation of user profiles and market research. 

If you visit our other social media presences without first logging out of your account or profile, the respective provider is generally able to assign the visit to your account or profile.

The legal basis for the processing of your personal data is Article 6 para.1 point f of the GDPR, insofar as this serves our legitimate interest in effective communication with and provision of information to users. If you consent to the processing in individual cases, Article 6 para. 1 point a of the GDPR is the legal basis.    

3. Data collection when contacting us 

You have the option to contact us via the contact forms, the messenger or the e-mail address provided. The data transmitted – your name, your request, etc. – will only be used for the purpose of processing your request, for follow-up questions, the processing of your jobs placed or for the processing of contracts concluded with you. We would like to point out that communication via e-mail may contain security gaps. It only guarantees limited confidentiality. 

The legal basis for data processing is Article 6 para. 1 point b of the GDPR, insofar as it concerns the initiation and, if necessary, execution of a contract. Furthermore, Article 6 para.1 point f of the GDPR is the legal basis. Our legitimate interest lies in answering and processing your request. 

Contact and content data will be erased after final processing of your request. This is the case if knowledge of the data is no longer required to fulfil the purpose pursued with the storage or if the storage is or has become inadmissible for other legal reasons, provided that there are no legal retention obligations to the contrary. 

4. Taking part in the game

You can also take part in various games on our website. No personal information is collected from you during the game. Upon successful participation, you will receive a prize code. You can then send us this code via our contact form to receive a gift by mail.

The following data will be processed when sending the prize code

  • Name, Surname

  • Company name

  • Postal address

  • Your winning code as proof of successful participation in the game.

The above information is mandatory, otherwise we will not be able to send you the gift. Your details will only be used to verify your successful participation in the competition and to send you the gift by post and will be deleted immediately after dispatch. Your details will not be shared with any third parties.

The legal basis for the data processing described above is Art. 6 par. 1 lit. f DSGVO. Our legitimate interest is to respond to and process your enquiry and your participation in the competition.

If you do not wish to receive a gift, you may object to the further use of your data at any time. To do so, please send a message to the address given in A. 1. or by email to info@mytalentscout.de.
